This website is operated by Soilutions. Throughout the site, the terms “we,” “us,” and “our” refer to Soilutions. Soilutions offers this website, including all information, tools, products, and services available from this site, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

By visiting our site and/or purchasing products or services from us, you engage in our “Service” and agree to be bound by the following Terms of Service (“Terms”), including any additional terms, conditions, and policies referenced herein or available by hyperlink.

SECTION 1 – ONLINE STORE TERMS

By agreeing to these Terms of Service, you represent that:

SECTION 4 – ORDERS, PRICING AND PAYMENT

All orders placed through this website are subject to acceptance by Soilutions.

We reserve the right to refuse, limit, or cancel any order for any reason, including:

  • product availability,
  • pricing or typographical errors,
  • suspected fraud,
  • misuse of promotions,
  • or other issues identified at our sole discretion.

Prices and product availability are subject to change without notice.

Payment is due in full at the time an order is placed. Refunds approved by Soilutions will be issued to the original payment method.

SECTION 5 – PRODUCTS AND PRODUCT CARE

We make every effort to display products and colors accurately; however, actual product appearance may vary based on natural material variation and screen settings.

Natural Product Variation

Soilutions products are made from natural and recycled organic materials. Variations in color, texture, particle size, moisture content, and composition are normal and expected.

Product images are representative only. Customers are encouraged to view products in person when exact appearance is important.

Agricultural Recycling Considerations

Due to the nature of agricultural organic recycling, products may contain trace amounts (≤0.1%) of produce stickers and/or food-safe plastic packaging fragments.

Product Care

Soilutions products contain living microorganisms and biological activity that require proper care and moisture management to perform as intended.

Products are often delivered at reduced moisture content to facilitate transportation and spreading. Customers are responsible for properly hydrating and caring for materials after delivery.

For best results, products should be moved into planting areas and watered within 72 hours of receipt.

Gardening and growing results vary depending on climate, irrigation practices, plant selection, maintenance, and numerous environmental conditions outside our control. We do not guarantee specific gardening, landscaping, or crop outcomes.

SECTION 6 – DELIVERY

Delivery dates and times are estimates only and are not guaranteed.

Customers are not required to be present during delivery. Soilutions may contact customers when materials are being loaded or dispatched.

Scheduling Bulk Deliveries

If you plan to have a crew spread your materials, we strongly recommend scheduling delivery for the day prior to installation.

Delivery windows are estimates and may vary due to weather, traffic, routing, equipment, or operational delays.

Driveway and Property Considerations

Fully loaded dump trucks are extremely heavy and may damage driveways, curbs, sidewalks, landscaping, irrigation systems, underground utilities, or other property conditions not visibly apparent.

Customers assume all risks associated with allowing delivery vehicles onto their property.

For residential driveways, we recommend dumping materials in the center of the driveway to distribute weight more evenly.

Soilutions shall not be responsible for property damage resulting from delivery access requested or permitted by the customer.

Access Requirements

Delivery trucks require approximately 30 feet of vertical clearance to safely raise the dump bed.

Customers are responsible for identifying:

  • overhead power lines,
  • low-hanging branches,
  • narrow gates,
  • unstable surfaces,
  • irrigation systems,
  • or any other site hazards.

Properties with access openings narrower than 10 feet may not be serviceable.

Drivers retain sole discretion regarding safe delivery access at the time of delivery.

Third-Party Delivery Services

Soilutions may utilize third-party transportation providers for deliveries.

Same-day delivery changes or cancellations may incur a $150 driver inconvenience fee.

SECTION 7 – RETURNS AND REFUNDS

Due to the nature of bulk landscape materials and delivery services, all sales are final once materials have been delivered.

Refunds, credits, or replacements may be offered solely at Soilutions’ discretion.

Approved refunds will be issued to the original payment method.

SECTION 8 – SMS/MMS MOBILE MESSAGE MARKETING PROGRAM TERMS

By opting into our SMS/MMS mobile messaging program (the “Program”), you agree to receive recurring automated marketing, conversational, informational, and promotional text messages from Soilutions, including messages generated or assisted by artificial intelligence (“AI”) systems.

Consent is not required as a condition of purchase.

Message frequency may vary. Message and data rates may apply.

AI-Powered Messaging

The Program may use artificial intelligence and machine learning technologies to generate:

  • personalized messages,
  • conversational responses,
  • promotional offers,
  • product recommendations,
  • and customer service communications.

You acknowledge and agree that:

(a) AI-generated messages may contain inaccuracies.

While we strive to provide accurate and helpful information, AI-generated messages may contain errors regarding:

  • pricing,
  • availability,
  • product details,
  • promotions,
  • recommendations,

Customers should independently verify information before making purchasing decisions.

Messages, replies, browsing activity, purchase history, and customer interactions may be processed by AI systems and trusted third-party service providers to personalize your experience and improve communications.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SOILUTIONS AND ITS SERVICE PROVIDERS SHALL NOT BE LIABLE FOR DAMAGES ARISING FROM:

  • inaccuracies in AI-generated content,
  • product recommendation errors,
  • pricing or availability errors,
  • reliance on AI-generated communications,
  • or interruptions or failures in AI-powered features.

ALL AI FEATURES AND COMMUNICATIONS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND.

SECTION 9 – DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY

ALL PRODUCTS, SERVICES, WEBSITE CONTENT, AND COMMUNICATIONS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

SOILUTIONS DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING:

  • MERCHANTABILITY,
  • FITNESS FOR A PARTICULAR PURPOSE,

These Terms of Service shall be governed by and construed in accordance with the laws of the State of New Mexico, without regard to conflict of law principles.

Continued use of the website or Services following any changes constitutes acceptance of those revised Terms.
